You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization.

LeadCaptain is offered on free and paid subscription plans. Paid plans provide access to additional features and usage as described at checkout. Plan features, limits, and pricing may be updated, and we will make reasonable efforts to communicate material changes.

You agree not to use LeadCaptain to:

• Violate any applicable law or regulation.
• Send unlawful, deceptive, harassing, or abusive messages.
• Infringe the rights of others or misuse their information.
• Distribute spam or send communications without required consent.
• Interfere with, disrupt, or attempt to gain unauthorized access to the service.

LeadCaptain uses AI to generate responses and suggestions. AI output is automated and may be inaccurate or incomplete. You are responsible for how the service is configured and for reviewing the conversations conducted on your behalf. Do not rely on AI-generated content as professional, legal, financial, or medical advice.

You are responsible for using LeadCaptain in compliance with the laws that apply to your business, including those governing communications, consent, privacy, and recording. You are responsible for the accuracy of the business information you provide and for how you follow up with your leads and customers.

LeadCaptain sends and receives calls and messages on your behalf. Availability of specific channels may vary, and communications depend on third-party networks that are outside our control. You are responsible for the content and consent basis of the communications you enable through the service.

If you enable SMS or text messaging features, the following disclosures apply to messaging programs conducted through LeadCaptain:

• Message frequency varies.
• Message and data rates may apply.
• Recipients may opt out at any time by replying STOP.
• Recipients may reply HELP for help.
• Where applicable, consent to receive SMS or text messages is not a condition of purchasing any goods or services.

Businesses using LeadCaptain remain responsible for obtaining any legally required consent from their recipients and for complying with applicable messaging requirements and carrier rules. LeadCaptain does not provide legal advice, and enabling these features does not guarantee compliance with the laws that apply to your business.

LeadCaptain relies on third-party providers for hosting, telephony, messaging, AI, and payments. Your use of the service may also be subject to those providers' terms. We are not responsible for the acts or omissions of third-party providers or networks.

Paid subscriptions are billed in advance on a recurring basis through our payment processor. Unless otherwise stated, fees are non-refundable except where required by law. You authorize us to charge your payment method for applicable fees until you cancel. Failure to pay may result in suspension or termination of access.

You may stop using LeadCaptain and cancel your subscription at any time. We may suspend or terminate access if you violate these terms, misuse the service, or as otherwise permitted by law. Upon termination, your right to use the service ends, and we may delete associated data consistent with our Privacy Policy.

To the fullest extent permitted by law, LeadCaptain and its providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the service. Our aggregate liability is limited to the amounts you paid for the service in the period giving rise to the claim.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate or fit for a particular purpose.
